Upon the entry into force of Act XXXVI of 2013 on Electoral Procedure, the National Election Office was established.
This independent, autonomous state administrative institutionis subordinate only to the law. Its task is to carry out the central duties related to the preparation and conduct of elections. The Office, like other election offices, performs tasks related to impartially informating voters, candidates, and nominating organizations, assists the work of the National Election Commission, ensures the material and technical conditions necessary for conducting elections, and directs the work of regional and local election offices. The Office is headed by its president, who is appointed by the President of the Republic on the proposal of the Prime Minister.

Procedure for requesting data of public interest
General Information
According to Act CXII of 2011 on the Right to Informational Self-Determination and Freedom of Information, any person may submit a request to the National Election Office for access to data of public interest and data that that is public for reasons of public interest (hereinafter collectively referred to as "public interest data"), either verbally, in writing, or electronically.

The procedure for fulfilling requests for access to public interest data.
The National Election Office (NVI) fulfils requests for public interest data as soon as possible, but no later than 15 days from the date of receipt. During an election period (the time between the announcement of an election and the finalization of its results), requests for public interest data related to that specific election will be fulfilled immediately, but within a maximum of 5 working days.
If a data request is unclear, the NVI will contact the applicant for clarification. This clarification period does not count toward the processing deadline.
The NVI is not obligated to fulfil a request if it is identical to a request submitted by the same person within the last year for the same set of data, provided there have been no changes to that data.
The National Election Office furthermore is not obligated to fulfil a data request if the applicant does not provide their name (or the name of the legal entity in the case of a non-natural person) and their contact details where any information or notification regarding the request can be provided.
If, at the time of submission or at any later stage of the process, it is determined that the data or part of the data requested is not managed by the National Election Office, the request will be immediately forwarded to the competent body, and the applicant will be notified simultaneously. If the competent body cannot be determined, the applicant will be informed.
If the data request is for a significant volume or a large number of data points, or if fulfilling the request would disproportionately utilize the resources required for the National Election Office's core activities, the standard 15-day deadline may be extended once by 15 days. The applicant will be informed of this extension within 15 days of the request being received.
An applicant can receive a copy of a document or part of a document, regardless of how it is stored.
A cost reimbursement may be charged for fulfilling the data request, up to the amount of the incurred costs. This fee is only applied if the costs exceed the minimum amount specified by a government decree. Even then, the fee cannot exceed the maximum amount also set by the decree.
Within 15 days of receiving the request, the National Election Office will inform the applicant of the cost and any options that do not require making copies. The applicant then has 30 days from receiving this information to state whether they wish to proceed with the request. The time between the notification and the applicant's response is not included in the fulfilment deadline.
If the applicant confirms their request, they must pay the fee within a deadline of at least 15 days, as set by the National Election Office. The request will then be fulfilled within 15 days of the payment being received, except during an election period.
If a request is denied, the National Election Office will send a written or electronic notification to the applicant within 15 days of receiving the request, explaining the reasons for the refusal.
Legal remedy
An applicant may file a lawsuit if their request for public interest data is denied, if the deadline for fulfilment (including any extension) expires without a response, or to request a review of the cost reimbursement amount. The lawsuit must be initiated within 30 days of receiving the denial, the deadline's expiry, or the due date for the cost reimbursement.
The applicant can also turn to the National Authority for Data Protection and Freedom of Information (NAIH) for violations related to the right to access public interest data. If an applicant files a complaint with the NAIH regarding the denial, non-fulfilment, or cost of a request, they can initiate a lawsuit within 30 days of receiving notification about the rejection of their complaint's review, the closure of the investigation, or the result of a call for a remedy to the violation.
If the deadline for filing a lawsuit has passed, an appeal for reinstatement of the deadline can be made.
