As a voter and EU citizen, you have the opportunity to submit requests in a number of matters related to the Hungarian elections. As a Hungarian citizen living abroad or as a member of a national minority, you can register to vote in the elections, request a mobile ballot box for voting, or submit a request to vote in a polling station other than your place of residence or abroad. You can choose which requests to submit depending on whether you have a Hungarian address.

Act CIII of 2023 on the digital state and certain rules governing the provisions of digital services (hereinafter: Dáptv.) contains the general rules governing electronic communication between bodies required to provide digital services and their customers, as well as provisions ensuring electronic administration.

The National Election Office (hereinafter: NEO) is obliged to provide digital services to its customers in accordance with Section 9 (2)(a) of the Dáptv.

The NEO accepts electronic forms using a secure delivery service on the Official Portal, which ensures the integrity of electronic forms and provides clear confirmation of their receipt and the time of receipt.

The NEO provides digital services through the Personalized Administration Interface (SZÜF) and the e-Paper service as follows:

PERSONALIZED ADMINISTRATION INTERFACE (SZÜF)

In accordance with the provisions of Act XXXVI of 2013 on the Electoral Procedure, the NEO provides citizens with comprehensive electronic administration options for submitting election-related applications at the Client Gate+ Service or Digital Citizenship Program mobile application. . The mobile ballot box application and the registration application are also available electronically, without online identification, for voters who do not have a Hungarian domicile (voters living abroad).

E-PAPER SERVICE

The e-Paper general-purpose electronic application form is a free, certified messaging application that connects customers electronically via an internet connection to institutions and agencies that have joined the service.

The purpose of the e-paper service is to enable customers to submit their applications electronically to the authorities regarding procedures or simple cases which, due to their frequency or other reasons, do not require support by a specialized system.

The e-Paper service can be accessed through the central identification agent (KAÜ) service, and is available at:https://epapir.gov.hu

Our clients can select the following types of cases from the NEO within the framework of the e-Paper service:

1.Request for data of public interest (National Election Office) [Submission of a request for access to data of public interest.]

2.Request for information/correction regarding the processing of personal data (National Election Office) [Requests that may be submitted in connection with the exercise of rights of data subjects under Act CXII of 2011 on the right to self-determination in relation to information and freedom of information.]

3. General information [Request for general information on legislation related to elections, referenda, European citizens' initiatives and the electoral process.]

4.Complaints, reports in the public interest [Complaints and reports in the public interest that may be submitted in accordance with Act CLXV of 2013 on complaints and reports in the public interest related to the activities of the organization.]

5.Legal remedy concerning applications for inclusion in the register of voters who do not have a Hungarian domicile [Appeal against a decision on an application for inclusion in the register (registration, extension of registration, cancellation of registration, modification of data, request for simplified information). The appeal may be lodged no later than 15 days after the decision has been made.]

6.Certificate of voting rights[Any adult citizen may request a certificate from the National Election Office confirming that, based on the register of disenfranchised citizens, there are no grounds for excluding him / her from voting rights.]

The Client Setting Register (RNY) serves to record the administrative dispositions and authorizations (powers of attorney) of clients.

The Client Setting Register is currently available athttps://rendelkezes.gov.hu/rny-public/welcomefollowing identification via the KAÜ service.

  • If the user (client) is an economic entity, it is required, pursuant to Section 26 (1) of the Digital State Act, to register its contact details for electronic communication in the Client Setting Register.
  • If the user (client) is a natural person, his/her official contact detail is the official contact registered in the Client Setting Register or the storage space associated with their digital citizen user profile.

Any complaints regarding electronic administration may be reported to the Digital Services Authority(https://www.dmu.gov.hu/ugyintezes).

Information on the rules of procedure relating to the operation of the internal abuse reporting system

In accordance with the provisions of Act XXV of 2023 on complaints, reports in the public interest, and rules related to reporting of abuses (hereinafter: Pkbtv.), the National Election Office operates an internal abuse reporting system. The detailed rules governing the internal abuse reporting system are set out in Presidential Instruction 1/2023. (VII. 21.) on the rules of the internal abuse reporting system.

Who is responsible for operating the internal abuse reporting system?

The tasks related to the operation of the internal abuse reporting system are performed by the integrity advisor employed by the NEO (hereinafter: advisor).

The advisor of the NEO is Tamás Jackli, dr.

Who is entitled to make a report?

Reports can be made in the internal abuse reporting system by

a) civil servants or employees employed by the NEO (hereinafter referred to as "employees"),

b) employees whose employment with the NEO has been terminated,

c) persons who wish to establish employment with the NEO and for whom the procedure for establishing such a legal relationship has been initiated,

d) sole traders and sole proprietorships if they have a contractual relationship with the NEO,

e) entrepreneurs, subcontractors, suppliers or persons under the supervision and control of the NEO, those who have initiated the procedure for establishing a contractual relationship with the NEO, or are in a contractual relationship with the NEO or have been in a contractual relationship with the NEO,

f) higher education students completing compulsory professional training at the NEO pursuant to Act CCIV of 2011 on national higher education,

g) persons wishing to establish a legal relationship or contractual relationship with the NEO pursuant to points d) or f) and in whose casethe procedure for establishing such a legal relationship or contractual relationship has been initiated, and

h) persons whose legal relationship or contractual relationship with the NEO pursuant to points d) or f) has been terminated.

What can the report contain?

In the internal abuse reporting system, persons entitled can report information relating to unlawful or suspected unlawful acts or omissions, or other abuses, in connection with the operation of the NEO.

How can I file a report?

The notification can be made

  • in person at the advisor's office (1054 Budapest, Alkotmány St. 3. third floor. office no. 335.),
  • by telephone at the advisor's contact number: +36-1-795-3312
  • in writing, by sending the document containing the report to the advisor (the document containing the report must be placed in a sealed envelope and the following must be indicated on the envelope: "1054 Budapest, Alkotmány St. 3., National Election Office", "For the Integrity Advisor", "CONFIDENTIAL"), or
  • electronically by sending the report to the email address visszaelesbejelentes@nvi.hu.

What happens after the report is filed?

How is the reporter's data handled?

The processing of the applicant's data is governed by the provisions of the Data Processing Policy.

Is there a possibility to appeal?

There is no possibility to appeal, but the complainant may submit a petition to the Commissioner for Fundamental Rights against the advisor's decision regarding the investigation of the report of abuse:

  • if he/she believes that the advisor did not fully investigate the report,
  • if he/she disagrees with the results of the advisor's investigation,
  • if the advisor considered the report to be unfounded.

Based on the request, the Commissioner for Fundamental Rights will investigate whether the report of abuse has been handled appropriately. If the investigation reveals any irregularities, the Commissioner may make recommendations to the advisor to remedy the situation.
