Who is eligible to vote?
Article XXIII of the Fundamental Law defines the right to vote as a fundamental political right: every adult Hungarian citizen has the right to vote in elections for members of the National Assembly (active voting right) and to be elected (passive voting right).
At the general election of Members of the National Assembly, voters living abroad also have – although with restrictions – the right to vote and to stand as candidates.
The right to vote and to stand as a candidate may only be restricted by the so-called natural circumstances for exclusion: a person shall be excluded from the right to vote and to stand as a candidate, if he/she has been disenfranchised by a court
- for having committed a crime, or
- for his/her restricted ability to understand the nature of his/her acts.
In its judgment relating to placement under guardianship partially or fully limiting capacity to act or delivered on the basis of a review procedure, the court shall be required to decide on the issue of disenfranchisement as well.
Based on this, the following persons are not eligible to vote and cannot be elected (i.e. they have neither active nor passive voting rights):
- those who are under exclusion from public affairs,
- those who has been disenfranchised by the court from exercising suffrage because, due to mental disorder, their ability to exercise that right
- is significantly reduced permanently or in a temporarily recurring manner, or
- is permanently and completely lacking.
Those who serve under a final and binding judgment, a sentence of imprisonment or subjected to compulsory psychiatric treatment in an institute ordered in a criminal proceeding, have the right to vote, but cannot stand as candidates.
Every adult Hungarian citizen has the right to vote at parliamentary elections, national referenda, and – provided that the voter does not have a domicile in another member state of the European Union – elections of Members of the European Parliament, however voters with no Hungarian domicile may only exercise their right to vote after registration.
Every adult Hungarian citizen whose Hungarian domicile is recorded in the register of addresses, is automatically registered in the central electoral register of the polling district of his/her domicile. Adult Hungarian citizens with no registered domicile in Hungary are listed in the central electoral register after registration. Some clarification on this point:
All Hungarian and European Union citizens of legal age residing in Hungary have the right to vote in general elections for local government representatives and mayors, as well as in local referendums. Adults who have been granted refugee status or long-term residence permits also have the right to vote.
Cannot vote and is not eligible to stand as a candidate (i.e., has neither active nor passive voting rights)
- anyone who is subject to disqualification from public affairs,
- who has been disqualified by a court from exercising the right to vote due to mental disorder, their capacity to exercise that right
- is permanently or periodically significantly reduced, or
- is permanently and completely absent.
Although they have the right to vote, persons who are serving a prison sentence based on a final judgment (provided that they are not disqualified from public office) or who are undergoing compulsory treatment in an institution ordered in criminal proceedings are not eligible to stand as a candidate.
All eligible voters are automatically enrolled in the electoral register of their place of residence. Voters who have established their place of permanent place of residence at least 30 days before the election (and whose residence remains valid until the day of the election) may vote at their permanent place of residence by absentee voting. If a voter votes by absentee voting (and there is no change in their registered address), they will remain on the register for their permanent place of residence until the next local election.
All adult Hungarian citizens who are eligible to vote in municipal elections may participate as voters in the general election of national minority self-government representatives, provided that they have registered as national minority voters prior to the election (by adding their names to the register of that minority).
Cannot vote and is not eligible to stand as a candidate (i.e., has neither active nor passive voting rights)
- anyone who is subject to disqualification from public affairs,
- who has been disqualified by a court from exercising the right to vote because, due to mental disorder, their capacity to exercise that right
- is permanently or periodically significantly reduced, or
- is permanently and completely absent.
Although they have the right to vote, those who are serving a prison sentence based on a final judgment (provided that they are not disqualified from public office) or who are undergoing compulsory treatment in an institution ordered in criminal proceedings are not eligible to stand as a candidate. Furthermore, European Union citizens residing in Hungary and adults recognized as refugees, immigrants, or settled persons are not eligible to vote in this type of election.
In the election of members of the European Parliament, all adult Hungarian citizens residing in Hungary, as well as citizens of other Member States of the European Union residing in Hungary, shall have the right to vote, provided that they declare that they wish to exercise their right to vote in Hungary. Furthermore, adult Hungarian citizens who are not resident in Hungary or in another Member State of the European Union are also eligible to vote.

- who has been disqualified by a court from exercising the right to vote because, due to mental disorder, their capacity to exercise that right
- is permanently or periodically significantly reduced, or
- is permanently and completely absent.
Although they have the right to vote, those who are serving a prison sentence based on a final judgment (provided that they are not disqualified from public office) or who are undergoing compulsory treatment in an institution ordered in criminal proceedings are not eligible to stand as a candidate. Furthermore, citizens of other Member States of the European Union who are resident in Hungary may not be elected if they have been excluded from exercising this right in their country of citizenship on the basis of the legislation or a court or administrative decision of that country.
Hungarian voters who have requested to be entered in the register for the EP elections in another Member State of the European Union are not eligible to vote.
