Observer mission for the European Parliament elections

Observer for foreign representations 

In the election of Members of the European Parliament, the nominating organizations may appoint a maximum of two observers per foreign representation to monitor the work of the election office and the voting process. The joint nominating organizations may jointly appoint up to two observers.

It is not possible to appoint an observer as a candidate or list observer for the elections of local government representatives and mayors and for national minority self-government representatives, which are held on the same day as the EP elections, as there is still no voting at diplomatic missions in these elections.

Only a voter on the central electoral roll can be an observer at a foreign representation.

The foreign representative observers:

  • must be reported to the National Election Commission,
  • by 4.00 p.m. on the 10th day prior to voting in Hungary.

The declaration must include the following information: 

nominating organization(s) drawing up a list

name of the nominating organization(s)

                                                 name of the person making the declaration

name(s) of the observer(s)

identity card of the observer(s)

or

if the observer(s) does not possess an identity card, the type and number of his/her official document certifying an identity card

designation of the foreign representation

date, signature

The original document containing the declaration can be handed in by anyone at the National Election Office, located near the National Election Commission, at 1054 Budapest, Alkotmány utca 3. It can also be submitted by post, and it must arrive by the above deadline at 1397 Budapest, Pf. 547. In addition, the notification may be submitted by e-mail or by e-signature. If submitted by electronic means, the signature of the representative of the nominating organization(s) of the contracting entity must be included on the mandate, authenticated by a qualified electronic signature, or an advanced electronic signature, the electronic signatory must be authorized to represent the nominating organization. In the case of submission by e-filing, the attached declaration must also be certified.

Following the declaration, the National Election Commission registers the observer(s). The costs related to the mandate and the activities of the observer shall be borne by the nominating organization that mandates the observer.

After the notification, the National Election Commission registers the observer at the foreign representation.

The registered observer at the foreign representation

  • may monitor the work of the foreign representation election office,
  • shall not influence or interfere with the voting or the work of the foreign representation election office, either actively or by means of coercive behavior,
  • record his/her observations after the voting ends in the protocol,
  • submit objections,
  • sign the sealed ballot box after the voting ends,
  • wear a registration card at the polling station.

The costs relating to the appointment and activities of the observer at the polling station shall be borne by the person who appointed him (the nominating organization).

Observers appointed to supervise voting documents

As there is a postal vote in the European Parliament elections, nominating organizations entitled to appoint a member to the National Election Commission and standing as a candidate in the election of Members of the European Parliament may appoint up to five observers to the National Election Office to check the voting documents and the legality of the counting of votes.

Observers may not be appointed to monitor voting documents in the case of lists for the elections of local municipal representatives and mayors and for national minority self-government representatives, which are held on the same day and in the same procedure as the European Parliament elections, as it is not possible to vote by postal ballot in these elections.

The Observer(s) can:   

  • be a voter on the central electoral roll, and
  • not be a member of the NEC or the NEO.

The Observer(s) must:

  •  be registered with the National Election Commission,
  • by 4 p.m. on the 10th day before the voting in Hungary.

or

Following the notification, the National Election Commission registers the observer(s). After the registration becomes effective, the observer shall pledge or take an oath before the President of the National Election Commission, in the wording provided for in the Law on Oaths and Pledges of Public Officials Act.

An observer who is registered and has pledged/sworn the oath

·  may observe the work of the National Election Office,

·  shall not interfere, either actively or through any form of intrusion, with the verification of the voting documents and the counting of the votes,

·  odge objections.

The costs related to the mandate and the activities of the observer shall be borne by the nominating organisation that mandates him.

Observers mandated to monitor the ballot box.

Nominating organizations standing as candidates in European Parliament elections may appoint up to two-two observers per municipality of a single mandate seat to be present at monitoring the ballot box.

No observer can be appointed to monitor the ballot box in the case of local municipal elections, elections of mayors and elections of members of national minority self-government, which are held on the same day and in the same procedure as the European Parliament elections, as there is no possibility of postal voting in these elections.
