Applying for polling district electoral register data for candidates, parties
Information on data provision during the election of members of parliament:
Pursuant to section 153 (1) a) of Act XXXVI of 2013 on the election procedure (hereinafter: Ve.), the name, address, age, and gender of voters listed in the electoral register may be disclosed,– with due regard to the provisions of Section 89 –
- at the request of the candidate – concerning the relevant constituency – by the election office operating alongside the single-member constituency election commission responsible for registering the candidate,
- at the request of the nominating organization that drew up the list - concerning the constituencies designated by the nominating organization - the National Election Office
shall transfer the data immediately after the payment of the data provision fee, but no earlier than after the registration becomes legally binding pursuant to Section 132 of the Ve.
Requests for data provision may only be submitted in writing. The data provided shall not include the name, address, age, and gender of voters who have prohibited the disclosure of their data pursuant to section 89 (1) of the Ve.
In a joint procedure, the data provided may be used by the person entitled to request it in relation to all elections concerned.
Requests for data disclosure pursuant to section 153 (1) a) of the Ve. must be submitted to the single-member constituency election office operating alongside the election commission responsible for registering candidates. Requests for data disclosure pursuant to section 153 (1) b) of the Ve. may be submitted in person to the National Election Office at 1054 Budapest, Alkotmány St. 3. during office hours, by post to 1397 Budapest, Pf.:547, or by email to nvb@nvi.hu. The condition for the provision of data under point a) is that the legally registered candidate certifies the payment of the data provision fee at the single-member constituency election office providing the data. The cost is three Hungarian forints per voter concerned by the data provision request, and the payment should be made to the account of the National Election Office. The register may only be issued after payment has been made.
The condition for the provision of data under point b) is that the nominating organization that has submitted the legally registered list certifies the payment of the data provision fee, which is three Hungarian forints per voter included in the data provision, to the account of the National Election Office. The list of voters may only be issued after this.
The fee shall be paid to the NVI's account number 10032000-00333616-00000000 held in the Hungarian State Treasury. The name and address of the individual candidate must be indicated in the transfer notification field, while the nominating organization must provide its court registration number. The candidate/nominating organization shall be informed immediately by the competent election office, or in the case of a nominating organization, by the NEO, of the fee determined and thus payable.
The following persons are authorized to request and receive data on behalf of a nominating organization that has been legally registered:
- the legal representative of the civil organization as registered in the court,
- a person authorized on the nominating organization's notification form by the legal representative to make declarations on behalf of the nominating organization,
- a person with a power of attorney in a private deed of full probative force or a public deed issued by the persons specified in points 1-2.
The request must contain the following information:
Possible ways of submitting the application:
- electronically, in accordance with the rules of electronic administration, to the Official Gate System of the Secretariat of the National Election Commission (NVBT KRID: 674469907), or by email to nvb@nvi.hu (in the case of independent candidates, as a document bearing an e-signature; in the case of nominating organizations, with a qualified or enhanced security electronic signature from their representative),
- in person, or
- by post.
The requested electoral register data will be made available on a data carrier. A handover protocol will be drawn up for the transfer.
The transferred data may only be used for direct political campaigning, and any other use, copying, or transfer to third parties is strictly prohibited!
Regardless of when the data was provided, the nominating organizations/candidates/parties with a group of representatives in the National Assembly must delete the data no later than 4:00 p.m. on the day of the election, and the minutes of this must be submitted to the election office by 4:00 p.m. within three days. (The minutes of the deletion may also be submitted by email in signed, scanned electronic form by the specified deadline.)
Please note that unauthorized use of data, failure to delete it, and failure to submit the report on its deletion may result in a fine being imposed on the basis of a complaint.
We would also like to draw the attention of all candidates, nominating organizations, and parties with parliamentary representation to the fact that the National Authority for Data Protection and Freedom of Information (NAIH) has already published several recommendations on its website (www.naih.hu) regarding data processing in connection with the elections, which all parties concerned are advised to take into account.
