Request, transfer, use and destroy data from voters in the voting list
Pursuant to Section 153 (1) of Act XXXVI of 2013 on Electoral Procedure (hereinafter: Ve.), the name, address, age, and gender of voters included in the polling station electoral roll – taking into account the provisions of Section 89 – shall be provided in the election of local government representatives and mayors:
a) upon the request of the candidate – limited to the relevant constituency – by the local election office operating alongside the local election committee competent for the candidate's registration, or in the case of a candidate for Mayor of Budapest, by the Budapest Election Office, b) upon the request of the nominating organization fielding a (metropolitan) compensation/county list – limited to the constituencies indicated by the nominating organization – by the National Election Office,
immediately after the payment of the data provision fee, but no earlier than after the legal validity of their registration pursuant to Section 132 of the Ve.
The request for data provision can only be submitted in writing. The data provision does not include the name, address, age, and gender of voters who have prohibited the disclosure of their data pursuant to Section 89 (1) of the Ve.
The condition for fulfilling the data provision pursuant to point a) is that the legally registered candidate certifies the payment of the data provision fee – which is three forints per voter included in the data provision – to the local election office that fulfills the data provision, or in the case of a candidate for Mayor of Budapest, to the Budapest Election Office. The electoral roll data can only be released after this. The candidate's personal identification number, or in its absence, the number of their valid identity card/passport/driver's license, must be indicated in the transfer's comment section.
The condition for fulfilling the data provision pursuant to point b) is that the legally registered nominating organization fielding a list certifies the payment of the data provision fee – which is three forints per voter included in the data provision – to the National Election Office's account. The electoral roll data can only be released after this. The committee resolution number regarding the registration of the list and the nominating organization's court registration number must be indicated in the transfer's comment section.

The following persons are entitled to request and receive the data provision on behalf of the legally registered nominating organization:
- the legal representative according to the court register of civil organizations,
- a person authorized by the legal representative on the nominating organization's notification form to make declarations on behalf of the nominating organization,
- a person with a private document of full probative force or a public document of authorization given by the persons specified in points 1-2.
Please include the following information in the request:
- the name and personal identification number of the requesting nominating organization/candidate,
- the legal basis for the request, i.e., reference must be made to Section 153 (1) a) or b) of the Ve. or to the fact that the data request is for the purpose of using electoral roll data for direct political campaigning,
- date, the name and signature of the person specified in point 1, or the candidate's signature. The document certifying the payment of the data provision fee must be attached to the request.
Possible ways to submit the request:
- electronically (as a signed scanned document),
- in person, or
- by post.
A request for data provision pursuant to Section 153 (1) a) of the Ve. must be submitted to the local election office operating alongside the local election committee competent for the candidate's registration, or in the case of a candidate for Mayor of Budapest, to the Budapest Election Office. A request for data provision based on a legally registered compensation/county list that can be submitted to the National Election Office pursuant to Section 153 (1) b) of the Ve.:
- can be submitted in person at 1054 Budapest, Alkotmány utca 3., during office hours,
- can be sent by post to 1397 Budapest, Pf.: 547,
- or can be sent by email to NVB@nvi.hu.
The requested electoral roll data will be provided on a data carrier. A handover protocol will be prepared for the transfer.
The nominating organization may only use the transferred data for the purpose of direct political campaigning; any other use, copying, or transfer to third parties is strictly prohibited!
Nominating organizations/candidates must destroy the data from the data provisions – regardless of the date of their fulfillment – no later than 4:00 PM on election day, and the minutes prepared on this must be submitted within three days to the election office that fulfilled the data provision. (The minutes of destruction can also be submitted in signed, scanned form by the indicated deadline.)
Please note that in case of unauthorized use of the data, or violation of the obligation to destroy the data and send the minutes of destruction – based on an objection to this effect – a fine may be imposed!
Furthermore, we draw the attention of all candidates and nominating organizations to the fact that the National Authority for Data Protection and Freedom of Information (NAIH) has published a recommendation on the handling of election-related data, which all parties involved are advised to take into account.
