Applying for Access to Data of Public Interest
General information
Pursuant to Act CXII of 2011 on Information Self-Determination and Freedom of Information, anyone can submit an application for accessing to data of public interest and data that is public for reasons of public interest (together public interest data) - verbally, in writing or electronically.
Requests for data of public interest are transferred to the National Election Committee through the Secretariat of the National Election Committee.
How to submit a request for accessing Data of Public Interest 1. In person at the National Election Commission Secretariat (1054 Budapest, Alkotmány street 3.) during office hours, from Monday to Thursday from 8:30 am to 4 pm on weekdays, Friday from 8:30 to 3 pm.

Processing of the requests
The President of the National Election Commission shall fulfill the request as soon as possible, but no later than 15 days from its receipt.
Under Act XXXVI of 2013 on the Electoral Procedure, in the period between the announcement of the election and the publication of the final results, requests for public interest data must be fulfilled within 5 business days.
If the request is unclear, the President may invite the applicant to clarify it. (The time needed for clarification does not count within the deadline.)
If the request concerns a large volume of data or its fulfillment would require disproportionate labour resources, the deadline may be extended once by an additional 15 days, and the applicant will be informed accordingly within the initial 15-day period.
Applicants may request a copy of the document containing the data.
If providing the data incurs costs, the applicant may be required to reimburse these; the amount will be communicated before completion.
Outside the election period, if fulfilling the request requires disproportionate labour resources or concerns extensive documentation, the request shall be fulfilled within 15 days after the reimbursement has been paid.
If the request is rejected, the Chairman of the National Election Commission shall inform the applicant electronically within 15 days, stating the reasons for rejection.
Remedies
The applicant may file a lawsuit to challenge the rejection of the request, the amount of the reimbursement fee (including any extension of the deadline), or the failure to fulfill the request.
Legal action must be initiated within 30 days from the notification of the decision, the expiry of the deadline, or the communication of the reimbursement fee.

If the applicant reports the case to the Authority due to rejection, non-compliance, or reimbursement, legal action may be taken within 30 days of the Authority’s decision, the termination or closure of its investigation, or any corrective measure ordered to the data controller.
If no court proceedings are initiated, a certificate may be issued upon request.
