Information on requesting, release, use and destruction of data from nationality voters in case of interim nationality election
In the event of a by-election for national minority self-government representatives, national minority organizations are also entitled to receive the name, address, age, and gender of voters who are registered in the electoral roll as voters of the specific national minority and are eligible to recommend and vote. However, the specifics of what data is released and how many times organizations are entitled to receive it are determined by the type of by-election.
All data provision is free of charge.
Data provision occurs ex officio only in the case of by-elections for local national minority self-governments, simultaneously with the issuance of the recommendation forms. This data provision includes the name and address of all national minority voters eligible to recommend the national minority candidate in the by-election. The prohibition on data disclosure does not apply to this data provision. The data file may only be used for the purpose of collecting recommendations; any other use, copying, or transfer to third parties is strictly prohibited!
In the case of by-elections for regional and national national minority self-government representatives, nominating organizations that field a list can only receive the names and addresses of national minority voters upon request, on the 38th and 13th days before the election, as no recommendations need to be collected for the list in these by-elections. This data provision may only be used for the purpose of direct political campaigning. This data does not include the names and addresses of national minority voters who have prohibited the disclosure of their data pursuant to Section 89 (1) of the Electoral Procedure Act (Ve.).
The following representatives of the national minority organization are entitled to request (for direct political campaigning) and receive the data provision:
- the legal representative listed in the public court register of civil organizations,
- a person authorized by the legal representative on form P4, or
- person(s) authorized by these individuals in a private document of full probative force or a public document.
The request must include the following information:
- the name of the requesting national minority organization as registered in the court register,
- the legal basis for the request, i.e., reference must be made to Section 317 (4) b) of the Electoral Procedure Act (Ve.) or to the fact that the data request is for the purpose of using electoral roll data for direct political campaigning,
- date, the name and signature of the requester.

The request can be submitted:
- electronically,
- in person, or
- by post.
In the case of sending the request by post, it can only be fulfilled if it arrives at the competent election office by the 38th or 13th day before the election.
National minority organizations must destroy the data from the data provisions – regardless of the date of their fulfillment – no later than 4:00 PM on election day, and the minutes prepared on this must be submitted to the election office that provided the data within three days. (The minutes of destruction can also be submitted in signed, scanned form by the indicated deadline.)
In case of unauthorized use of the data, or violation of the obligation to destroy the data and send the minutes of destruction – based on an objection to this effect – a fine may be imposed!
Furthermore, we draw the attention of all candidates and nominating organizations to the fact that the National Authority for Data Protection and Freedom of Information (NAIH) has published a recommendation on the handling of election-related data, which all parties involved are advised to take into account.
