9/2010. OVB resolution on the mandate of regional and national minority self -government representatives
At its meeting on 3 December 2010, the National Electoral Committee (hereinafter: Ve.) 115/I (8) (a) of the Act, the following
resolution
give it out.
Act CXIV of 2005 on the election of minority self -government representatives and the amendment of certain laws for national and ethnic minorities. Pursuant to Article 12 of the Act, the voter and elected in the regional minority self-government elections, who is a member of the municipal minority self-government (Elektor).
According to the provision set out in Article 13 of the Act, "the mandate of the representative body of the territorial minority self-government shall be until the next election of the regional minority self-governments".
Pursuant to Article 21 of the Act, the above provisions shall also apply to the election of national minority self-government representatives.
According to the National Electoral Committee, it follows from the above that the mandate of the territorial or the national minority self -government representative does not cease if the representative has not obtained a mandate in the meantime, but his term of office is until the day of general territorial and national minority elections.
