7/2010. OVB resolution on the collection of referral coupons by mail

The National Election Committee - at its meeting held on August 31, 2010 - acting within its competence as laid down in Section 90/A (4) a), Section 99/K (5) a), and Section 105/A (4) a) of Act C of 1997 on Electoral Procedure (hereinafter: Ve.), issues the following

According to the provision in Section 47 (1) of the Ve., "a candidate can be recommended on a recommendation slip by handing over the filled-out recommendation slip to the candidate or the representative of the nominating organization." According to the position of the National Election Committee, the grammatical interpretation of the law implies that the voter does not deliver their recommendation slip to the candidate or nominating organization through an intermediary body.

Therefore, as a consequence of the above provision and the principle of good faith and proper exercise of rights laid down in Section 3 d) of the Ve., a recommendation collected by a nominating organization via post does not meet the conditions of a lawful recommendation.

Based on the above, the method of collecting recommendation slips sent to the voter by post, with a pre-printed address, postage paid, and then mailed by the recommender, does not meet the conditions laid down in the Ve., therefore the invalidity of a recommendation slip collected in this way can be established on the basis of Section 50 (1) c) of the Ve.
