7/2008. (VI. 25.) OVB resolution on the deadlines for the local referendum*
The National Election Committee, as laid down in Section 144/A (4) of Act C of 1997 on Electoral Procedure (hereinafter: Ve.), issues the following
resolution
in connection with the application of the deadlines for calling a local referendum.
According to Ve. Section 4 (1), "the election must be called at least 60 days before the day of the vote. The election must be called so that the day of the vote does not fall on a national holiday or a public holiday according to the Labour Code, or on the day before or after them."
Based on Ve. Section 141, "the representative body or the metropolitan or county assembly (...) shall set the date of the referendum simultaneously with the order for the referendum, for a date within four months from that date."
The National Election Committee establishes that the rule laid down in Ve. Section 141 is a special provision, which, however, does not replace but supplements the general provision laid down in Ve. Section 4. When calling a local referendum, both rules must be taken into account, as Ve. Section 4 determines the earliest possible date of the referendum, and Ve. Section 141 determines the latest. Thus, based on the cited provisions of the Ve., a local referendum must be called for a date no later than four months from the order, and at least 60 days from the order.
