7/2006. (III. 9.) OVB resolution on the unrepeatable of the recommendation (beyond force)
The National Election Committee, acting within its competence laid down in Section 90/A (4) a), Section 99/K (5) a), and Section 105/A (4) a) of Act C of 1997 on the electoral procedure (hereinafter: Ve.), issues the following
resolution
on the non-repeatability of the recommendation.
According to Ve. Section 46 (1), "Candidates can be recommended on a recommendation slip. The recommendation slip must be delivered to the voters together with the notifications."
According to subsection (4), "The recommendation cannot be withdrawn."
According to Ve. Section 47 (1), "A candidate can be recommended on the recommendation slip by handing over the filled-out recommendation slip to the candidate or the representative of the nominating organization."
According to Ve. Section 50 (3), "The recommendation of a person who has recommended more than one candidate is invalid."
The National Election Committee states that the recommendation process on the part of the recommending voter is concluded with the handover of the recommendation slip to the candidate or the representative of the nominating organization.
The recommendation cannot be withdrawn, therefore if a registered candidate drops out for any reason (for example, resigned in writing, died, or lost their right to vote), or if the recommendation slips of a candidate who is not yet registered are not submitted for any reason, the voter cannot make another valid recommendation for another candidate.
The recommendation slips handed over to the candidate or the representative of the nominating organization cannot be re-written for another candidate retroactively.
