The National Election Committee, using the authorization granted in Section 34 (2) a) of Act C of 1997 on Electoral Procedure (hereinafter: Ve.), issues the following
resolution
According to Section 46 (1) of the Ve., a candidate can be recommended on a recommendation slip. According to the second sentence of Section 47 (2) of the Ve., "the recommending voter writes their family and given name, address, personal identifier, the family and given name of the person being recommended, the name of the nominating organization, or the fact of independent nomination on the recommendation slip." According to Section 49 (2) of the Ve., "a joint candidate can only be nominated on the basis of recommendation slips on which the names of all the nominating organizations nominating the given joint candidate are indicated."
In the interpretation of the referenced provisions, the National Election Committee, in its resolution 2/1998. (III. 14.) OVB, established that "the will expressed by the voter during the filling out of the recommendation slip must be respected to the greatest possible extent."
The voter is often not aware of the exact, registered name of the candidate or the nominating organization. All this can cause problems in practice during the qualification of the recommendation slips.
Therefore, in order to enforce the will of the voter, those recommendation slips on which the candidate's name is not in the form appearing in the registry, but is otherwise clearly identifiable (e.g., maiden name, assumed name, etc.), or on which the name of the nominating organization appears in a form different from the official designation but can be established beyond any doubt (e.g., short name, acronym, etc.) must also be accepted as valid.
In the case of a joint nomination, the recommendation slip must contain the names of all the nominating organizations nominating the candidate, in a form that corresponds to the interpretation explained above. The order of the nominating organizations on the recommendation slip is not important.
