6/2006. (III. 9.) OVB resolution on campaign silence (out of force)

The National Election Committee, acting within its competence as laid down in Section 90/A (4) a), Section 99/K (5) a), Section 105/A (4) a), Section 115/I (8) a), Section 124/A (3) a), and Section 143/A (4) of Act C of 1997 on Electoral Procedure (hereinafter: Ve.), on the subject of the campaign blackout, issues the following

According to Section 41 of the Ve., "[A] violation of the campaign blackout is considered to be influencing the electoral will of the voters, including in particular: services provided free of charge to voters by the candidate or the nominating organization (organized transport to the polls, giving food and drink), distribution of party badges, flags, party symbols, objects containing the candidate's photograph or name, placement of election posters (hereinafter: posters), provision of information suitable for influencing the electoral will by electronic or other means."

According to the National Election Committee's position, Section 41 of the Ve. is not violated if press products containing information suitable for influencing the electoral will, which were published before the campaign blackout came into effect, remain available for purchase during the campaign blackout at their previous distribution locations and under the conditions that existed before the campaign blackout came into effect.

However, it is a violation of the campaign blackout if the distribution of the written press product begins on the day of the campaign blackout.
