5/2008. (II. 12.) OVB resolution on the certificate on vote
The National Election Committee, acting within its competence laid down in Section 90/A (4) a), Section 99/K (5) a), and Section 124/A (3) a) of Act C of 1997 on the electoral procedure (hereinafter: Ve.), issues the following
resolution
Ve. "Section 89 (1) A voter who, on election day, is away from their place of residence but within the territory of Hungary, may apply for registration in the electoral register with a certificate requested from the head of the local election office with jurisdiction over their place of residence, from the head of the local election office of the settlement where they are on election day - or on election day from the ballot-counting committee. Based on the certificate, the voter can vote in the Hungarian settlement where they are located. The purpose of requesting the certificate cannot be to influence the outcome of the election in a way that constitutes an abuse of rights.
(7) Based on the certificate and the document suitable for proving identity and place of residence, the head of the local election office with jurisdiction over the place of stay or the ballot-counting committee designated for voting with a certificate shall register the voter in the electoral register and in a separate register.
Based on Ve. Section 89, a certificate can be issued for both a settlement other than the voter's place of residence and for the voter's place of residence, because in the latter case it may also happen that the voter is away from their place of residence (e.g. in a hospital, correctional facility). Those who are in their own settlement on election day but outside the area of the polling district corresponding to their place of residence can be registered in the electoral register of the polling district designated for voting with a certificate, and - if necessary - can exercise their right to vote with a mobile ballot box.
Simultaneously with the publication of this resolution in the Hungarian Gazette, the National Election Committee repeals its Resolution 12/2006. (IV. 6.) OVB.
