3/2003. (II. 21.) OVB resolution - On the national referendum announced by the Constitution, on order for electoral committees*
The National Election Committee, acting within its competence as laid down in Section 34 (2) a) of Act C of 1997 on Electoral Procedure (hereinafter: Ve.), issues the following
resolution
on the appointment to election committees in a national referendum called by the Constitution:
According to Section 125 (1) of the Ve., the submitters of the initiative may send one common representative to the election committees - with the exception of the National Election Committee - and the parties that did not participate in the submission of the initiative but have a parliamentary group may send one representative each. Paragraph (2) provides that, as a member of the National Election Committee, organizations that submitted the initiative but do not have a parliamentary group may appoint one common representative.
Based on the interpretative provision of Section 149 i) of the Ve., "'submitters of the initiative' are: in the case of a citizens' initiative for a referendum and a popular initiative, the organizations and private individuals who submitted the initiative".
The Ve. clearly defines the composition of the election committees in its provisions containing differences for national referendums. If the referendum is not based on a citizens' initiative, but is initiated by the President of the Republic, the Government, or one-fifth of the parliamentary representatives, or is called by the Constitution, then there are no "submitters of the initiative" according to the Ve. Taking this into account, only parties with a parliamentary group may send one representative each to the election committees.
