3/1998. (III. 18.) OVB resolution - on the use of names for those who started as candidates in the parliamentary election*

The National Election Committee, using the authorization granted in Section 34 (2)a)of Act C of 1997 on Electoral Procedure (hereinafter: Ve.), issues the following resolution on the use of names by candidates in the parliamentary election:

According to Section 47 (2) of the Ve., the recommending voter writes their address, personal identifier, and their own handwritten signature, the family and given name of the person being recommended, and the name of the nominating organization or the fact of the independent nomination on the recommendation slip.

According to Section 52 (2) of the Ve., the candidate's registration must contain the candidate's family and given name, personal identifier, address, and a declaration that they have the right to vote, accept the nomination, and do not hold any office that is incompatible with the representative's mandate, or will resign from it if elected.

According to Section 96 (2) of the Ve., the ballot paper for the individual constituency contains the official family and given names of the candidates in alphabetical order: according to paragraph (3), the names of the first five candidates on the list, as well as the fact of any list connection, must be indicated on the regional list ballot paper - in the order announced by the nominating organization.

In the application of Section 47 (2) of the Ve., the recommendation slip is still valid if the candidate is recommended under a name that appears on the candidate's identity card and on the basis of which the candidate's identity can be established.

In the application of Section 52 (2) and Section 96 (2)-(3) of the Ve., the family and given name of the candidate is to be understood as the name to which the candidate is entitled according to the birth or marriage registry (birth or married name).


The validity of the recommendation slip or the candidate's registration is not conditional on the candidate's name containing the designation referring to the use of a doctoral title, as specified in Section 30 of Government Decree 168/1999. (XI. 24.) on the issuance and registration of identity cards.


The validity of the recommendation slip or the candidate's registration is not affected if the candidate's name on the recommendation slip or during the candidate's registration also contains an assumed name borne on the basis of Section 77 (2) of Act IV of 1959 on the Civil Code. If the candidate's registration also contains an assumed name, it must be indicated on the ballot paper next to the candidate's name.
