Constitutional Court Resolution 6/2007. (II. 27.) AB annulled Section 8 (1) of Act C of 1997 on the electoral procedure. In accordance with the decision of the Constitutional Court, the National Election Committee establishes the valid text of its Resolution 11/2006. (III. 30.) OVB as follows:

The National Election Committee, acting within its competence laid down in Section 90/A (4) a), Section 99/K (5) a), Section 105/A (4) a) and Section 124/A (3) a) of Act C of 1997 on the electoral procedure (hereinafter: Ve.), issues the following

resolution

on opinion polls conducted on election day.

Ve. Section 8 (2) a) states that opinion polls conducted on election day can only be anonymous and must be based on voluntariness.

Ve. Section 8 (2) b) states as a further restriction that pollsters may not enter the building where the polling station is located, may not disturb voters in any way, and may only question those who are leaving the polling station.

It is clear from the general justification of Ve. Sections 6-8 that Section 8 (2) b) contains a set of guarantees and restrictions concerning opinion polls conducted using the so-called exit-poll method. The act, however, does not prohibit the continuation of opinion polls conducted by other methods on election day, provided that they are conducted within the limits set in Section 8 (2) a) and their results are published at the earliest after the closing of the polls.
