2/1997. (XII. 1.) OVB in principle
Acting within its competence as laid down in Section 21 (1) of Act C of 1997, the National Election Committee, exercising the authorization granted in Section 34 (2) a) of the Act, issues the following resolution:
According to Section 8 (7) of Act XXXIV of 1989 on the election of Members of Parliament, when calculating the percentage threshold under subsection (5) bb), the votes cast for a joint list must be divided among the affected parties according to a declaration made by them in advance - uniformly nationwide - based on Section 9 (3), or, in the absence thereof, in equal proportions. According to Section 9 (3) of the same Act, the fractional votes of a joint individual constituency candidate and a joint regional list are added to the national lists of the parties that nominated the joint candidate or joint list, in a proportion determined in advance by the parties concerned - uniformly nationwide - according to subsection (2).
The term "uniformly nationwide" means that in all cases of a jointly nominated candidate or list, the parties that nominated the candidate or list will receive the votes and fractional votes in a percentage proportion that is identical for all applications, as recorded in the parties' prior agreement.
