17/2002. (IV. 15.) OVB resolution - The transfer of copies of the voting records to the members of the Voting Counting Committee (outside the scope)

The National Election Committee, acting within its competence as laid down in Section 34 (2) a) of Act C of 1997 on Electoral Procedure (hereinafter: Ve.), issues the following

According to Section 74 of the Ve.: "(1) A record must be made of the counting of the votes and the determination of the polling station and election results. A record cannot be made with a pencil.
(2) The records must be prepared in three copies, which are signed by the members of the election committee present.
(3) The competent election committee shall hand over one copy of each record to the representatives of the candidates present, upon their request. After duplication, the president of the election committee shall authenticate the copy with a stamp impression and their signature."
According to Section 75 (1) of the Ve., "the vote counting committee shall immediately transport the records, election documents, forms, and ballot papers - together with the ballot box - to the local election office."
Based on Section 75 (1) of the Ve., the members of the vote counting committee are jointly obliged to immediately transport the polling station records, election documents, forms, and ballot papers to the local election office.
Since the members of the vote counting committee are jointly present until the record is handed over to the local election office, the duplication and handing over of the record according to Section 74 (3) of the Ve. can lawfully take place primarily at the polling station, or if this is not possible, at the local election office.
