16/2002. (IV. 10.) OVB resolution - About the list of voters that change the address (outside the scope)

The National Election Committee, acting within its competence as laid down in Section 34 (2) a) of Act C of 1997 on Electoral Procedure (hereinafter: Ve.), issues the following
resolution:
According to Section 71 (1) of Act XX of 1949 on the Constitution of the Republic of Hungary, "parliamentary representatives... are elected by citizens on the basis of universal and equal suffrage, by direct and secret ballot."
According to Section 1 of Act XXXIV of 1989 on the election of parliamentary representatives, "suffrage is universal and equal, and voting is direct and secret."
According to Section 3 a) and d) of Act C of 1997 on Electoral Procedure (hereinafter: Ve.), "in the application of the rules of the electoral procedure, the participants concerned in the election must enforce the following fundamental principles:
a) preserving the integrity of the election, preventing electoral fraud,
d) exercising rights in good faith and for their intended purpose.
According to Section 16 (1) and (2) of the Ve.:
"(1) If a voter has changed their address after the preparation of the voter register, the head of the local election office with jurisdiction over the new address shall - at the same time as the registration - register them in the voter register and inform them by giving them a notification.
(2) The head of the local election office shall immediately notify the head of the local election office with jurisdiction over the former address in order to remove them from the voter register. The head of the local election office with jurisdiction over the former address shall ex officio inform the head of the local election office with jurisdiction over the new address that the citizen
a) was on the voter register, or
b) was on the register of adult citizens without the right to vote, and the reason for this, or
c) received a certificate according to Section 89 or Section 104, or
d) was neither on the voter register nor on the register of adult citizens without the right to vote."
According to Section 89 (1) of the Ve., "a voter who is away from their place of residence on the day of the vote may request to be registered in the voter register of the local election office of the settlement where they are staying on the day of the vote - or from the vote counting committee on the day of the vote - with a certificate requested from the head of the local election office with jurisdiction over their place of residence. Based on the certificate, the voter may vote in the settlement where they are staying."
The principle of equal suffrage implies that every voter can only participate in the election of one individual constituency representative.
If a voter changes their address between the two rounds of the election in such a way that they establish a place of residence in a constituency where a second round is being held, from a constituency where the first round of the election was valid and successful, they cannot be registered in the voter register.
If the voter voted with a certificate in the first round, it must be examined whether the election in the constituency for which the certificate was issued was valid and successful.
