13/2006. (IV. 13.) OVB resolution on certain issues of moving tour (beyond force)

The National Election Committee, acting within its competence laid down in Section 90/A (4) a), Section 99/K (5) a), Section 105/A (4) a), Section 124/A (3) a), Section 131/A a), and Section 143/A (4) of Act C of 1997 on the electoral procedure (hereinafter: Ve.), while maintaining Resolution 12/2002. (IV. 2.) OVB, issues the following

According to Ve. Section 61 (3), "In order to enable a voter with a mobility impairment to vote, the ballot-counting committee shall visit them with a mobile ballot box upon request, with at least two members."

According to the regulation contained in the Ve., voting with a mobile ballot box must be requested by the voter with a mobility impairment, and their intention must be announced to the ballot-counting committee. The law does not regulate the form of the request or announcement.

The voter may use assistance to announce their intention, but the National Election Committee is of the opinion that it violates the electoral principles of preserving the integrity of the election, preventing electoral fraud, and the good faith and proper exercise of rights contained in Ve. Section 3 a) and d), if anyone publishes a call for voting with a mobile ballot box, offers intermediary services, or engages in any other form of mobilization activity in order to organize the voting.

The National Election Committee also states that it violates the principle of voluntary participation contained in Ve. Section 3 b) and the principle of the integrity of the election contained in Ve. Section 3 a) if someone requests a mobile ballot box for another voter without their knowledge.
