The National Election Committee, acting within its competence as laid down in Section 34 (2)a) of Act C of 1997 on Electoral Procedure, issues the following
resolution
regarding the electoral mandate of mayors:
According to Section 31 (2) of Act LXXVII of 1993 on the rights of national and ethnic minorities: "The national self-government shall be elected by minority electors. A minority elector is every municipal representative who was elected as a minority representative, and the local minority self-government representative, as well as the spokesman."
According to Section 32 of Act LXV of 1990 on local self-governments: "The mayor is a member of the representative body, and shall be considered a municipal representative for the purposes of the quorum, decision-making, and operation of the representative body."
The National Election Committee has established that there is no legal provision that would exclude a mayor from being an elector, therefore mayors elected as minority candidates are entitled to participate in the electoral assemblies that elect the national minority self-government.
