12/1998. (IX. 15.) OVB resolution - on the mandate of members of the voting counting committees

The National Election Committee, acting within its competence as laid down in Section 34 (2) a) of Act C of 1997 on Electoral Procedure (hereinafter: Ve.), issues the following

resolution

on the mandate of the elected members of the vote counting committees:

Section 22 (1) of the Ve. stipulates that only a voter residing in the constituency can be a member of the election committee. The definition of constituencies is contained in Section 101 of the Ve. during the election of local government representatives and mayors.

The provision contained in Section 22 (1) of the Ve. cannot be deviated from. If the elected members of the vote counting committee do not meet the legal requirements of Section 22 (1) of the Ve. with regard to the constituencies listed in Section 101 of the Ve., their mandate shall cease by operation of law in accordance with Section 26 (4) a) of the Ve.

In the event of the termination of a mandate, Section 27 of the Ve. provides for the filling of vacant vote counting committee positions. If the vacant vote counting committee positions are filled by the territorial election committee by appointment, the law does not require the fulfillment of the residency requirement laid down in Section 22 (1) of the Ve.
