The National Election Committee, acting within its competence as laid down in Section 34 (2) a) of Act C of 1997 on Electoral Procedure (hereinafter: Ve.), issues the following
resolution:
According to Section 3 a) and c) of the Ve., "in the application of the rules of the electoral procedure, the participants concerned in the election must enforce the following fundamental principles: a) the preservation of the integrity of the election, the prevention of electoral fraud, c) equal opportunities for candidates and nominating organizations".
According to Section 33 (2) c) of the Ve., the territorial election committee "approves the content of the ballot papers for the constituency". According to Section 21 (1) of the Ve., "the election committees are independent bodies of citizens, subordinated exclusively to the law, whose primary task is to determine the election result, to ensure the integrity and legality of the elections, to enforce impartiality and, if necessary, to restore the legal order of the election."
According to Section 96 (3)-(5) of the Ve., in the election of parliamentary representatives, "the regional list ballot paper shall contain the names of the nominating organizations in the order drawn by the committee. The ballot paper shall contain the names of the first five candidates on the list - in the order announced by the nominating organization - and the fact of any list connection". Also, "on all ballot papers, next to the name of the nominating organization, its abbreviation, and a black and white imprint of its symbol or emblem must be indicated at the request of the nominating organization".
"In the case of a joint candidate or a joint list, the names of all nominating organizations must be indicated on the ballot paper".
According to Section 110 (4)-(6) of the Ve., in the election of local government representatives, "the capital city and county list ballot papers shall contain the names of the nominating organizations in the order drawn by the election committee. The ballot paper shall contain the names of the first five candidates on the list - in the order announced by the nominating organization". "On the capital city and county list ballot papers, and on the mayor's ballot paper, next to the name of the nominating organization registered by the court, its abbreviation, and a black and white imprint of its symbol or emblem must be indicated at the request of the nominating organization. "In the case of a joint candidate and a joint list, the names of all nominating organizations must be indicated on the ballot paper."
Based on the above rules, all lists (whether independent or joint lists) - and their candidates - must be given the same column width on the list ballot papers, the names of the nominating organizations and the candidates must be shown in the same font and font size in accordance with the legal provisions and the announcement of the nominating organization or list, and the emblems of the nominating organizations must be shown at the same height.
