The National Election Committee, acting within its competence as laid down in Section 26 of Act XXXIV of 1989, issues the following principled resolution based on the provisions of Section 30 (11) of the Act:
According to Section 20 (1) of Act XVII of 1989 on referendums and popular initiatives, the provisions of Act XXXIV of 1989 on the election of parliamentary representatives are applicable for the conduct and determination of the results of a national referendum - with the additions and deviations prescribed in the referendum law.
Act XVII of 1989 does not contain different or supplementary provisions for the various forms of election campaigns, including election rallies, so the rules found in Chapter IV of Act XXXIV of 1989 must be applied to them.
According to Section 10 (7) of the Electoral Law, election rallies are public, and it is prohibited to hinder or disrupt them. The organizer of the rally is responsible for maintaining order according to the rules of the law on the right of assembly.
The rules of the Electoral Law on election rallies also apply to national referendums.
