Registration of citizens of other EU Member States regarding the election of Members of the European Parliament

A citizen of another Member State of the European Union living in Hungary may decide to exercise their right to vote in the election of the Members of the European Parliament in Hungary and to participate in the election of the Hungarian Members of the European Parliament.

What do you need to do?

To be entered/removed from the register, you must submit an application.

The application can be submitted electronically, in person, or by proxy.

   1. Electronically

Applications can be submitted electronically, with electronic identification, via the Personalised Administration Interface available at www.magyarorszag.hu  by clicking here.

   2. Application can be submitted in person or by proxy at any local election office

The application can be submitted orally in person, the form required for submitting the application by proxy can be filled out and printed here.

Attention! In the election of the Members of the European Parliament, the voter of the Member States of the European Union can only cast their vote in one country. The National Election Office of Hungary informs the Member State of the voter's nationality of the inclusion of a citizen of another Member State of the European Union in the Hungarian register, which Member State removes the voter from the register there.

Attention! Based on your application, you will be included in the Hungarian register - and therefore you will not be able to vote in the Member State of your nationality - in the upcoming elections on the Members of the European Parliament (unless you request to be removed from the Hungarian register in the meantime or cancel your Hungarian address or lose your right to vote).

Attention! The personal data provided in the application must be identical to the data provided in the applicant's address certificate or official identity document (identity card, passport or driving licence issued by a Hungarian authority) and the applicant's address in Hungary must be valid.

When submitting the application, it is possible to provide a notification address to where – beside your storage location - the National Election Office of Hungary can deliver the decision.

Deadlines

The application can be submitted at any time, regardless of the elections, but in order to be considered in the next election, the following deadlines must be followed:

  • in the case of a request for registration, 4 p.m on the 16th day before the voting day,

  • in the case of a request to be removed from the register, 4 p.m. on the 10th day before the voting day


Documents to be submitted

Apart from the application, no other documents need to be submitted.

Payment obligation

There is no payment obligation for submitting an application.

Superior body/remedy

An appeal may be filed against the decision of the National Election Office of Hungary regarding the inclusion/removal from the register of the citizens of another Member State of the European Union, at the latest on the fifteenth day following its decision.

The appeal must be submitted in writing to the National Election Office of Hungary:

- by e-mail: to fellebezes[kucac]nvi.hu e-mail address

- by post: Nemzeti Választási Iroda, 1397 Budapest, Pf. 547. or

- in person: 1054 Budapest, Alkotmány utca 3.

The National Election Office of Hungary decides on the grant no later than the fifteenth day after its receipt, and in the case of an appeal against a decision taken after the election has been called, no later than on the working day after its receipt, but no later than 3 p.m. on the second day before the election.

If the National Election Office of Hungary upholds the appeal, it modifies the register and adds the applicant to the Hungarian register/deletes the applicant from the Hungarian register for the election of the Members of the European Parliament.

If the National Election Office of Hungary does not entertain the applicant's appeal, the appeal shall be submitted to the Metropolitan Court of Justice no later than the last day of the deadline available for its assessment. The court shall decide on the appeal no later than the fifteenth day following its receipt, or within three days following its receipt in the case of a decision taken after the election has been called, but no later than the day before the election.

Representation by a lawyer is not mandatory in court proceedings.

If the court considers the appeal to be well-founded, it modifies the decision, otherwise it rejects the appeal.

Other information

The National Election Office of Hungary processes the application, makes and delivers the decision - for all application forms – by using the electoral IT system, without human intervention, within the framework of an automatic decision-making procedure, with the following exceptions:

  • in the case of a request submitted personally or by proxy, the administrator performs:

    • identification of the person,

    • recording the application, handing over the decision,

  • the assistance of an administrator is provided in the cases specified in paragraph (5) of Article 93 of Act XXXVI of 2013 on Electoral Procedure (e.g. discrepancy between the data of the applicant in the application and the data in the central register). After the assistance of an administrator, the application is processed by automatic decision making.

To vote, the applicant must:

  • be a citizen of a Member State of the European Union,

  • have reached the age of 18 (or married before that age)

           Attention! However, you can submit the application from the age of 17, if

  • you have a registered address in Hungary and

  • neither in Hungary nor in the Member State of your citizenship are you excluded from the right to vote.

Hungarian citizens living in Hungary are automatically entered on the register for the European Parliamentary elections, so they cannot submit such an application.
