IV. Initiation of national referendum and the submission of the national popular initiation
The signature collection form for national referendum and national popular initiation must be submitted to the National Election Committee.

Please note: The National Election Committee considers the initiation submitted if the name and address of the submitter (in case of non-governmental organizations, the name and seat of representative) is provided along with the signature collection forms.
In the case of national referendum and the national popular initiation, both the proposed questions (terms of content) and the signature collection forms (terms of layout) must adhere to legal regulations.
1. Conditions with respect to content (drafting of questions)
– the proposed questions must fall in the scope of competence of the Parliament,
– the proposed question must be precise and clear,
The conditions with respect to content of a National referendum (Nsztv. 10. §), are
– the proposed question must fall in the scope of competence of the Parliament (Article (1) of § 28/B of the Constitution),
– the proposed question must have definite answers (Article (1) of § 13 of Nsztv.),
– the proposed question must not be amongst the banned topics (Article (5) of § 28/B of the Constitution):
“(5) National Referendum can not be held concerning the following topics:
a) of the budget, the implementation of the budget, the centrally defined tax and duty types, customs duties, the contents of laws concerning terms of local taxes,
b) obligations resulting from effective international contracts and laws pertaining to these obligations,
c) regulations of the Constitution concerning the national referendum and the popular initiation,
d) questions under the jurisdiction of the Parliament, which concern certain persons or matters of organizational restructuring (restructuring, dissolving),
e) the dissolving of the Parliament,
f) the program of the Government,
g) declaration of state of war and state of emergency,
h) the deployment of the Hungarian Army abroad or in the country,
i) the dissolving of municipal governments,
j) the practice of general pardon”)
-- the proposed question can not be similar to any questions for which a successful national referendum was held within the past three years (article d) § 10. Nsztv.)
-- the content of the proposed question should not be similar to any of the questions that were validated by the National Election Committee (this moratorium is effective until the referendum takes place or the initiation is refused; the failure of submission of signature collection forms until the proposed deadline) (§12. Nsztv.)
2. Formal regulations (signature collection forms)
A sample of the signature collection form must be submitted both for the initiation of national referendum and national popular initiation. The necessary requirements of the signature collection forms are detailed in articles (3) and (4) of §118. of the
